Restaurant owners go to court over rights to heart attack food theme

(Tele­graph UK) Jon Basso, owner of the Heart Attack Grill in Chan­dler, Ari­zona, claims that Iggy Lena and Bob Kut­nick stole his idea of a restau­rant spe­cial­is­ing in high-​​cholesterol food when they cre­ated the Heart Stop­pers Sports Grill in Del­ray Beach, Florida. Mr Basso’s law­suit demands that the pair cease and desist-​​change their med­ical dis­as­ter theme or stop trading.

But a lawyer for Heart Stop­pers insists that the two are “com­pletely dif­fer­ent”, not­ing that unlike the Ari­zona out­post, the Florida eatery’s menu does not include Sin­gle and Dou­ble Bypass hamburgers.

Robert Kain, a lawyer for Mr Basso, said the law­suit counts about 30 sim­i­lar­i­ties between the two restau­rants, from the EKG heart mon­i­tor imagery on their logo to the free food offer for cus­tomers over 350 pounds.
